Colorado vs. New York: Key Differences in Probate


  • Colorado offers an informal probate option for straightforward cases with a valid Will and no disputes. This can reduce court involvement, legal costs, and delays.

  • New York requires a formal probate process through the Surrogate’s Court, even in uncontested cases. It’s more structured and court-supervised from beginning to end.

When Is Probate Required?


  • There is no revocable living trust in place to avoid probate

  • The estate includes real estate or titled assets in the decedent’s name alone

  • There are bank or investment accounts without named beneficiaries

What is Ancillary Probate?


If your loved one owned real estate or other titled property in a state other than where they lived, a second probate process—called Ancillary Probate—may be required in that other state. One way to avoid this burden is by using tools like a revocable living trust, which can streamline the transfer of multi-state assets without multiple court proceedings.
